The Humble petition on behalf of the O.P. №2 above named.

Most Respectfully Sheweth :-

  1. That today is the date fixed for hearing Argument & BNA of this case.
  2. That on the last date i.e. on 10/07/2024, this O.P. filed a Petition/Application to dismiss the Complaint Petition №354/2022 or merge the petition with another case being No. CC/353/2022 on the ground that facts and contents of both the cases are treated by the Complainant as the same claiming the same relief for avoiding pendency and accumulation of multiple litigation proceedings with the same/similar cause of action and facts.
  3. That on that date i.e. on 10/07/2024 vide Order №15 Ld. District Commission was pleased to pass an Order that the aforesaid Petition of this O.P. should be disposed of at the time of final disposal of the present case no. CC/354/2022.
  4. That in view of the above this O.P. further prays before Your Honour to dispose of at first the said Petition/Application dated 10/07/2024 filed by this O.P. before hearing Argument of this case, otherwise this O.P. will be highly prejudiced and also multiple litigation proceedings with the same/similar cause of action and facts will be arise.
  5. That the petition made is bonafide and for ends of Justice.

Hence it is prayed that Your Honour may graciously be pleased to pass an order of disposing at first the said Petition/Application dated 10/07/2024 filed by this O.P. before hearing Argument of this case for ends of justice.
And for this act of kindness Your Petitioner as in duty bound shall ever pray.
